Director Charged with Corporate Manslaughter

A reliance on annual H & S surveys to fulfill your Health & Safety Policy cannot be justified.
The first case is being brought under new provisions of the Corporate Manslaughter and Corporate Homicide Act 2007.  Both a company and one of its Directors face charges corporate manslaughter  gross negligence.  The company faces an unlimmited fine, but the director faces a miximum sentence of life imprisonment.
This is a stark warning that all businesses should ensure that they are properly exercising their duty of care to their employees and have a robust and comprehensive health & safety and risk management process to prevent accidents.
Under the 2007 Act an organisation is guilty of corporate manslaughter if the way in which its activities are managed or organised causes a death and amounts to a gross breach of a duty of care to the victim.
