Health & Safety responsibilities
The defendants in a recent case brought under the Health & Safety at Work Act were found liable for the death of an employee even though the exact cause of the accident could not be established (Riley v Chargot Ltd, t/a Contract Services, and others).
It was ruled sufficient that the general state of affairs at the place of work increased the risk of injury, rather than identifying and proving a specific breach of duty. Consequently the burden of proof falls on the employer to show that their health and safety arrangements comply fully with the law.
