New Pregnancy and Work Guidance

The Department for Business, Innovation and Skills (BIS) has published new guidance on pregnancy, maternity and paternity rights for both employers and employees for babies due on or after 3 April 2011.

The two new guides published by BIS summarise the rights and obligations of pregnant employees and their employers in relation to babies which are due on or after 3 April 2011.

The employee guidance sets out what pregnant women must do under the law to benefit from protection, including paid time off for ante-natal appointments, maternity leave and pay and the right not to be treated unfairly because of their pregnancy, child birth or maternity leave.  It also includes new guidance on additional paternity leave and pay. The employer guidance sets out the support available for employers, such as how they can get help with working out if they need to pay statutory maternity pay and how to claim it back if they do.  Again, the guidance has a new section on additional paternity leave and pay.
