The cost of Tribunal lies
A recent EAT has ruled that costs should be awarded against a claimant making false allegations.
In the case of Daleside Nursing Home Ltd v Matthew, the original tribunal held ruled that there had not been direct race discrimination but even though the allegation was based upon a lie, no costs order was made.
The appeal tribunal, however, reversed the decision and concluded that where there is a clear-cut finding that the central allegation was a lie, the claim constitutes unreasonable action and consequently costs can be awarded against the Claimant.
